Agreement to Terms
By accessing or using Treatment Plan's platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a dental practice or organization, you represent that you have the authority to bind that organization to these Terms.
Description of Service
Treatment Plan is a done-for-you patient conversion platform for dental and orthodontic practices. We provide:
- Creation and delivery of personalized, interactive treatment plan pages for patients
- SMS and email delivery of treatment plan links
- Automated follow-up messaging sequences
- Patient scheduling and engagement analytics
- A staff dashboard for practice teams
Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately if you suspect unauthorized access to your account
- One practice may have multiple authorized users under role-based access controls
Acceptable Use
You agree to use the Service only for its intended purpose and in compliance with all applicable laws. You will not:
- Use the Service to send spam, unsolicited communications, or messages unrelated to dental treatment
- Attempt to access patient data belonging to another practice
- Share account credentials with unauthorized individuals
- Reverse-engineer, decompile, or attempt to extract source code from the Service
- Use the Service in any way that violates HIPAA or applicable patient privacy laws
Patient Data and HIPAA
Treatment Plan acts as a Business Associate under HIPAA. All patient data handling is governed by our Business Associate Agreement (BAA), which is executed separately with each practice.
- You (the practice) are the Covered Entity and remain responsible for obtaining appropriate patient consent
- We process Protected Health Information (PHI) only as directed by you and as permitted under our BAA
- We implement administrative, physical, and technical safeguards as required by the HIPAA Security Rule
- We will notify you of any breach of unsecured PHI within 72 hours of discovery
Fees and Payment
- Subscription fees are billed monthly in advance
- Fees are non-refundable except as required by law or as stated in your service agreement
- We reserve the right to change pricing with 30 days' written notice
- Failure to pay may result in suspension or termination of your account
Intellectual Property
The Service, including its design, code, features, and documentation, is owned by Treatment Plan and protected by copyright and intellectual property laws. Your use of the Service does not grant you ownership of any intellectual property.
Content you upload (practice logos, treatment descriptions, media) remains your property. You grant us a limited license to use it solely to provide the Service to you and your patients.
Availability and Support
- We aim for 99.9% uptime but do not guarantee uninterrupted access
- Scheduled maintenance will be communicated in advance when possible
- Support is available via email during business hours
Termination
- You may cancel your account at any time by contacting us
- We may suspend or terminate accounts that violate these Terms
- Upon termination, we will provide a 30-day window to export your data
- Patient-facing treatment plan pages will be deactivated upon account termination
Limitation of Liability
To the maximum extent permitted by law, Treatment Plan's total liability for any claim arising from or related to the Service shall not exceed the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.
Indemnification
You agree to indemnify and hold Treatment Plan harmless from any claims arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation, including HIPAA.
Governing Law
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts located in Los Angeles County, California.
Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
